I am flabbergasted. I thought we were long past the "________ need not apply" days in this country. The unemployed, it seems are the new Irish, "coloreds," long-hairs, "queers" -- name your favorite persecuted group.
Really, how can this be legal? You can't discriminate on the basis of race, religion, sexual orientation, marital status or a thousand other criteria. But apparently...
It is not against the law for companies to exclude the unemployed when trying to fill positions, but Judy Conti, a lobbyist for the National Employment Law Project, said the practice is a bad one.
No shit it is "a bad one." Discriminating against people based on circumstances that may well be completely out of their control is bad. Discrimination is bad. I thought we had settled that sometime around 1965.
So are the unemployed now eligible to be rounded up and sent to work camps? What other indignities await the jobless now that we are, apparently, officially second-class citizens, unprotected against discrimination?
The other thing that is so incredibly stupid about this is that companies are restricting their applicant pools and quite possibly filtering out the most enthusiastic and skilled candidates. You want somebody who will show up for work on time and pour their heart into the job every day out of sheer gratitude? Hire somebody who's been out of work for a while.
Our country is so messed up that it has actually become absurd.

It's part of a wider problem
It's part of a wider problem - applying boom practices to bust cycles. Companies such as Sony certainly aren't going to let up on the practice of hiring employed candidates so long as the labor market is scarce. It looked like a bad cut-and-paste job on behalf of the hiring manager (he forgot to remove his own notes).
They removed the tag after all of the negative publicity, but it makes no difference. While the unemployed may be be formally "considered," they will only be considered after all employed candidates. They will receive "Thank you for your interest in our company. Unfortunately, we have decided to pursue other candidates. Blah blah blah..."
Gaps in the work history have long been considered a huge negative on a resume. Even if a blatant "no unemployed candidates considered" was determined discriminatory, it is still just one determinant on a long list which includes:
1) Credit history
2) Investigative background check
3) All prior jobs and gaps (which could be from another recession such as '00-'01)...
...among other factors that may or may not be discriminatory but are still considered all the time, which can all be lumped into the "better candidate" category.

This article enraged me. It's really just the final extension to what I've finally concluded after 19mo. on the dole. Long term unemployed need not apply. That has been the tacit policy that poor old slobs, like me at 58, have had to figure out. It is virtually impossible to prove discrimination for age let alone for being out of work. I've read a story about a woman who was offered a job but was later disqualified because she had a bad $300 debt on her credit report.
Everyone needs to wake up. We are being herded and treated as cattle, slaves or prisoners. ALL BY DESIGN!!!! This is no mistake. This is where they (the bankers that have hijacked Washington and the sick socialists of govt.) want the middle class today, suffering poverty and servitude due to a lack of jobs or income producing endevors.
How do you deal with this and not get red eyed angry? Well, all you sheep out there better strap on your helmets. Q4 this year will bring understanding to all of you regarding the fate that is coming our way. It's going to be nasty... Those with jobs today will feel my pain soon as you get dumped in the shitcan of life. You'll be asking "What is happening?!" or an equally dumb "How could this have happened?". I love that last one. It always comes from the sheep who have entrusted being an informed citizen to their local whore ... er... politician...

What I hope is that we can build something new and just let the old die a natural death. Unfortunately, paradoxically enough, the "sheep" are disorganized. If only we could get together, pool our skills and develop and implement plans, we could work miracles together.
The problem is that only corporations and governments have that sort of organization in place, and they've made us dependent on them. The solution, I guess, would be to form collectives and co-operative businesses to challenge the status quo. The average corporation is so incredibly inefficient that we could definitely kick their asses in a lot of sectors.

Discrimination is against the law but as a recruiter I saw it with my own eyes - companies calling for young bucks - and other companies only wanting young women to pretty up their companies - if our company didn't fill the request another would because America is the home of screw thy neighbor as long as I make a dollar in my pocket.
Look at all our jobs outsourced to other countries... money rules the bottom line and the companies.
Add - I had an African American manager tell me she didn't like hiring white people because they don't get along with Spanish or African Americans - my mouth dropped since I am as white as you can get. She told me I was a minority at our company. I said "I don't think anyone cares..." Discrimination goes on all the time – the companies just don't come right out and say it.
Look what happened to me - only people over 50 were laid off and add we were all white – no Spanish or African Americans were laid off. I was surprised when I read this article though because when I was a recruiter, the companies didn’t have a problem with someone who was laid off – because they were available sooner – no need to give a 2 week notice. This was new news to me too.

I have read so many articles about this - it should be illegal to discriminate against the unemployed but this would be a hard thing to prove. I think all of us should send our resumes out stating we are still employed - you know - no end dates on our last jobs. If we are completing applications online, enter presently employed. Explain when you get to the interview either the system wouldn't let you go ahead with the app or you made an error. At least you will get your foot in the door. Then dazzle them!
What I would like to know is how many of the UE are over the age of 50? All the folks laid off in the RIF where I worked were over the age of 50. (I am thinking about doing something about looking old - heck I put my kids through college, so now it might be time for me to do a little something for me...) I have read that 90% of people laid off over the age of 50 will not be getting jobs and those who get jobs will not get jobs to match their past salaries. We gained 13,000 jobs in June and there are 15 million UE.….

Verified - Unemployed Need Not Apply
I had a conversation yesterday with a recruiter I worked with in the past. She said "yes" the companies are telling her they do not want to see the resumes of the unemployed, especially the candidates out of work over a year. I think one solution is to volunteer so we can enter this information on our resumes under our work experience. This will help fill in the gap - she said the biggest gripe from the employers is because we can collect UE, many at a higher rate than taking low paying jobs, we look lazy. I am sure if they were laid off they would do the same thing – why would we accept a job for less than we can collect? Someday I hope they have to walk ten thousand miles in our shoes. Anyway, I wanted to share this information with you.

I spoke to the recruiter who worked at an agency - I worked at this agency with her in the past. I am sure she will not tell me the names of the companies stating they do not want resumes from candidates who are laid off. She brought up this subject on her own – she thought she was telling me a bit of information I was not aware of. That’s when I told her I read about this happening on the Internet.
She is the last employee at this company - it's her and the owner, that's it. Reason: the small agencies are not making it in the big corporate world. They are getting squeezed out. All the big corporate companies are working with the big agencies and have national contracts at a very low mark up rate - they make their money based on volume instead of quality of the candidates. These vendors *and there are a lot of them out there* do not meet with potential candidates like the small agencies do - they find resumes online (they sign up with Monster.com, Careerbuilder.com etc to search their data bases) and work with the candidates via email. No more face-to-face interviews with these big recruiting companies. That's why I think everyone should do something during this time to fill in the gap of unemployment.

My son in law has been laid off almost 2 years - today he was offered a job - at a great salary with large company - HP. So there is hope for all of us! I am relieved for my daughter. Phew! It was tough - she has twins - 3 yrs old. It's great to know not all the big companies are passing over the resumes of the laid off folks. May the force be with all of us that the same good news is just around the corner for us too.
