Rules of Collecting Unemployment
Information to help your claim
A lot of people looking for tips on the ins and outs of collecting unemployment benefits find this site. To that end, I try to provide very simple explanations that carry over from state to state. Specific rules and regulations vary widely so make sure to contact your state's unemployment office if you are unclear.
Generally, though, the following three rules apply in every state:
- You must not be working (or you must be earning under a very low amount per week). That's obvious, no? A lot of people search for, "Can I sell on E-bay and collect unemployment?" Maybe, maybe not. It depends on how much money you make and what state you live in. I know for a hard-learned fact that New York will jack you out of your benefits if you make a single penny because they see it as a "business activity." Not all states are so harsh.
- You must be willing and able to work. This means that if you are offered a job, you have to take it. If you are offered a job and you do not accept it, you are not eligible.
- You must actively be seeking work. It is extremely important that you keep a log of all of your job seeking activities! I have heard horror stories of people losing benefits or having their claims contested on these grounds. States are broke now and looking to cut anywhere they can -- including your rightful benefits.
As I said, specific rules are different in each state, but the above framework is used in every state as far as I know.
Additionally -- and this is very important -- you must jump through every hoop in a timely manner! If the unemployment office sends you a card telling you to attend a workshop, attend it, and get there 15 minutes early. If they ask you for confirmation of address, confirm it. Read everything that comes in the mail, and do what it says. Otherwise, you will cost yourself money that you deserve.
Good luck!
